Dear Credit Union Leaders, 

Schools have started up already in many places around the state, football is just around the corner, and the Tigers are firmly out of contention in the AL Central – all traditional signs that Michigan Fall is almost here! As September approaches, here are the updates you need.

Announcements

Our Compliance Office Hours are normally held at 9:00 a.m. on the first Friday of every month.  However, due to the rescheduled ASFM Golf Outing, the next session will be held on the second Friday next month, Sept. 13.  Also, the next “Cheers! To Compliance” session is scheduled for Sept. 27. For more information, please contact Brad (Bradley.Willett@mcul.org).

Advocacy

In Lansing, the State Legislature has recessed for the summer.  The U.S. Congress has also recessed for in-district work.

When the legislature returns this fall, our team will continue its focus on proposed garnishment and collections reform as possible action approaches in Senate Committee. The Michigan Supreme Court’s recently-issued decision reinstating ballot-driven mandatory paid sick leave provisions and minimum wage increases will result in legislative efforts this fall by the greater business community, to re-amend the statutory provisions and alleviate some of the more harmful effects of the original proposal – our team will be engaged with the coalition and other stakeholders on these efforts. In addition, we will be carefully watching other efforts on GAP insurance, consumer protection act reforms, and working on changes to undo an inadvertent legislative error on consumer notice in new vehicle contracts in the Motor Vehicle Sales Finance Act.

As we mentioned in the last edition, U.S. Rep. Maxine Waters (D-CA), along with U.S. Sens. Richard Blumenthal (D-CT) and Elizabeth Warren (D-MA), introduced the Protecting Consumers from Payment Scams Act (H.R. 9303 and S. 4943, respectively). The bill would amend the Electronic Fund Transfer Act (EFTA) to define an unauthorized transfer as one that includes a fraudulently induced transfer, and requiring financial institutions to reimburse consumers for this type of fraud. It would also define merchant charges for undelivered goods as “errors” along with misdirected payments resulting from information a consumer initially provided. EFTA’s current carveout for wire transfers would also change, with the bill treating remittance transfers the same as other electronic fund transfers subject to EFTA’s framework for error resolution and consumer reimbursement. As an industry, we strongly oppose these bills. They are not expected to pass in the current session, but it will be important to ensure that this legislation does not gain any momentum for future sessions. An Action Alert has been set up to assist credit unions in contacting their members of the U.S. Congress to communicate opposition to this measure. If you haven’t already, we strongly encourage you to take action and let our Michigan delegation know of your opposition.

Grassroots and Advocacy Funding

 As a reminder, Hike the Hill takes place from Sept. 9-11 in Washington, D.C. If you are attending and haven’t yet signed up, an optional bus tour that includes stops at the National Archives, Lincoln Memorial and Arlington National Cemetery has been added to the agenda for Sept. 11. Elections

As noted previously, the November General Election will take place on Nov. 5. As per our normal practice during election cycles, a full list of endorsed state and federal candidates will continue to be included at the bottom of this update and will be updated onto our website. The next meeting of the Executive Committee of the Government and Political Affairs Forum where endorsements will be considered is Aug. 26.
