Announcements

Advocacy
In Lansing, the State Legislature has returned in full for one week, last week, and the state Senate will convene weekly (or so) until the November Election. Proposed garnishment and collections reform did not appear in the Senate FICP Committee this past week, but remains a possibility moving forward as the sponsor and various stakeholders continue negotiations. The Senate FICP Committee did post and then cancel a hearing on SB 888 and a series of trailer bills dealing with data privacy and notification issues. Backed by the Office of Attorney General, there are some positives but several large concerns in the introduced version of these bills, notably the ability of OAG to compel testimony and documents outside of any formal hearing from any person they “reasonably believe” may have information or documentation relevant to a violation of the state Identity Theft Protection Act, without further due process protections. Amending the newly re-instated mandatory paid sick leave provisions and minimum wage increase remains an active legislative push by the greater, united business community. The legislative schedule will likely preclude action before the General Election, but optimism remains that both parties recognize the need for changes for employers to functionally implement what will be required.
In Washington, D.C., we continue to monitor efforts related to interchange reform, in particular as “must-pass” bills begin to get more traction toward the end of the year. As previously mentioned, we continue to urge our credit union community to reach out to our federal lawmakers to convey opposition to the Protecting Consumers from Payment Scams Act (H.R. 9303 and S. 4943, respectively). These bills, introduced by U.S. Rep. Maxine Waters (D-CA) in the U.S. House and U.S. Sens. Richard Blumenthal (D-CT) and Elizabeth Warren (D-MA) in the U.S. Senate, would amend the Electronic Fund Transfer Act (EFTA) to define an unauthorized transfer as one that includes a fraudulently induced transfer, and requiring financial institutions to reimburse consumers for this type of fraud. If you have not yet used it, an Action Alert has been set up to assist credit unions in contacting their members of the U.S. Congress to communicate opposition to this measure. We do not expect this to pass this session, but we want to get ahead of it for next session and to continue to combat the growing drumbeat to shift accountability from other parties on to financial institutions. This week, America’s Credit Unions and the state leagues communicated to congressional members our industry’s opposition to amendments to the National Defense Authorization Act (NDAA) that would incorporate any of these themes into that legislation as it moves closer to passage.

Grassroots and Advocacy Funding
As mentioned in the last edition, we are looking ahead to 2025 America’s Credit Unions GAC in March of next year. The Michigan hotel block sold out extremely quickly, but we do anticipate that rooms will open up. Elections
As noted previously, the November General Election will take place on Nov. 5. As per our normal practice during election cycles, a full list of endorsed state and federal candidates will continue to be included at the bottom of this update and will be updated onto our website. The next meeting of the Executive Committee of the Government and Political Affairs Forum where endorsements will be considered is Oct. 28.
